Participant acknowledges he or she is voluntarily participating in and/or consuming The Products and hereby voluntarily assumes all risk of loss, damage, injury, illness, or death that may be sustained as a result of participation in and/or consumption of The Products. In consideration for participating in and/or consuming The Products, Participant, on his or her own behalf, and on behalf of all other persons claiming by, through or under you, hereby releases Fonsies Insane Hot Sauce its subsidiaries, and, as applicable, their franchisees as well as their respective independent contractors and successors and assigns (referred to hereinafter as the “Company Parties”), from all rights, claims and actions, including claims for personal injury of a Participant, death of a Participant and/or damage to property of a Participant, arising out of the Participant’s participation and/or consumption of The Products, whether or not said injuries, death or damage were caused by the negligence or other acts or omissions of the Company Parties. Participant agrees for himself or herself, and for his or her heirs and legal representatives, to indemnify and hold harmless the Company Parties from and against any and all damages, actions, causes of action, claims, judgments, costs of litigation and attorney’s fees which may in any way and at any time result from Participant’s participation and/or consumption of The Products. Participant of the Fonsies Insane Chocolate Challenge and the Fonsies Insane Roulette Challenge agrees that the Company Parties have the worldwide license and right to use Participant’s name, voice, picture or likeness in any advertising, broadcasting or promotional material (including in-store signage) without providing further notice and without providing any financial or other compensation, and Participant hereby releases the Company Parties from any claims arising therefrom.

If Participant is gifting or purchasing The Products for someone other than himself or herself, Participant agrees to inform the recipient of these terms of use and conditions of consumption. Failure to inform recipient of these terms of use and conditions of consumption indicates Participant’s voluntary acceptance of personal responsibility and Participant agrees to wholly assume all risk of loss, damage, injury, illness, or death that may be sustained as a result of Participant recipient’s

Fonsies Insane Hot Sauce is entitled to refuse an order if there is a serious shortcoming by the customer with regard to the order of the customer.

Shipping in Belgium to home address 6.4 euros

Shipping in Belgium to Bpost pick-up point 5 euro

Shipping to the Netherlands via B Post to a pick up point 11 euro

Shipping to the Netherlands to a home adress 11.6 euros

Shipping worldwide depends on weight and will be displayed on the website when purchasing any item.

Unless otherwise agreed or expressly provided otherwise, the goods are delivered to the Customer in the EU within 7 days after receipt of the order , coutries outside the EU make take longer. Any visible damage and / or qualitative deficiency of an item or other defect in the delivery must be reported to Fonsies Insane Hot Sauce without delay.

Art 7 : Right of withdrawal

4.1 If there is a consumer purchase, in accordance with the Distance Selling Act (Section 7: 5 Dutch Civil Code), you have the right to return the delivered goods within 14 days without giving any reason.

This period starts at the moment that the ordered items are delivered. If you have not returned the goods delivered to Fonsies Insane Hot Sauce after the expiry of this period, the purchase is final.

You are obliged to notify Fonsies Insane Hot Sauce in writing within the period of 14 days after delivery, before proceeding to return the goods. Return of the goods must be in the original packaging and in new condition and to the address

If the items have been used with you, encumbered or damaged in any way, the right to terminate within the meaning of this paragraph will lapse.

With due observance of what has been stipulated in the previous sentence, Fonsies Insane Hot Sauce will ensure that within 15 days after good receipt of the return shipment, the full purchase price including the calculated shipping costs will be refunded to you.

The return of the delivered goods is entirely at the expense and risk of you. If the returned product is reduced in value in some way, Fonsies Insane Hot sauce reserves the right to hold the Customer liable and demand compensation for any value reduction of the goods resulting from the use of the goods by the Customer goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.

Fonsies Insane Hot Sauce will reimburse the Customer with the same payment method with which the Customer has performed the original transaction, unless the Customer has explicitly agreed otherwise; in any case, the Customer will not be charged for such reimbursement

The delivered articles remain the exclusive property of Fonsies Insane Hot Sauce until the moment of full payment by the Customer.

The Client undertakes, if necessary, to inform third parties of the retention of title of Fonsies Insane Hot Sauce, for example to anyone who would come to seize the articles that have not yet been fully paid.

Art 9 : Penalties for non-payment

Without prejudice to the exercise of other rights held by Fonsies Insane Hot Sauce, in the event of non-payment or late payment from the date of the default, the Client owes an interest of 10% per annum on the unpaid amount. Fonsies Insane Hot Sauce cannot be held responsible for abuse of the sauce for jokes or intentional abuse to hurt others.

Fonsies Insane Hot sauce cannot be held responsible for bodily injuries that can be caused both internally and externally by our products.

Not suitable for heart patients, pregnant women and people with stomach and bowel problems.

KEEP OUT OF THE REACH OF CHILDREN.

Art 15 : Disputes

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The courts of the place of residence of the Consumer are competent in legal disputes.
